Terms of Service
These Terms govern your use of Live Chilli at livechilli.com (the “Service”), operated by Chilli (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Who may use the Service
You must be at least 18 years old and able to enter a binding contract. The Service is for professional photographers and studios. You are responsible for your account, credentials, and anyone who uses the Service through you.
2. What Live Chilli is
Live Chilli helps you receive photos from a camera workflow, publish live guest galleries, and share them (including via links or QR). Features, quotas, and limits may change. We do not guarantee uninterrupted availability.
3. Your content, your responsibility
You own or control the photos and materials you upload or publish (“Content”). You are solely responsible for Content and for how it is shown to guests.
You represent and warrant that:
- you have all rights, licences, and permissions needed to upload, store, and publish the Content;
- publishing the Content does not violate law, third-party rights, or event rules;
- where the law requires consent or notice for photos of people, you have obtained it or will obtain it;
- you will not upload Content you are not allowed to use.
4. GDPR and roles for event photos
For photos and guest data in your galleries, you are the data controller. Live Chilli provides tools and hosting and acts as a processor (or equivalent) on your instructions.
You are responsible for:
- lawful basis, notices, and consents for photographing and publishing people;
- what guests can see, gallery passwords, public links, and QR codes;
- responding to guest privacy requests that relate to your Content;
- deciding how long galleries stay available and when Content is deleted;
- if you enable Find me, having a lawful basis to create a face index from event photos, accepting the Data Processing Agreement, and informing guests that face recognition is active.
We process account data as described in our Privacy Notice. Find me processing is also covered by the DPA.
5. Guests and galleries
If you share a gallery link or QR, anyone with access may view (and, if enabled, download) Content. You must inform guests as required by law. We are not responsible for how guests use Content after they receive it.
6. Prohibited use
You may not use the Service to upload, store, or share Content that is illegal, or that involves child sexual abuse material, non-consensual intimate imagery, extreme violence used unlawfully, malware, or infringement of others’ rights. We may remove Content, suspend accounts, and report to authorities where appropriate.
7. Storage, quotas, expiry
Accounts may have storage and monthly photo limits. Galleries may expire based on settings you choose or defaults we set. Expired or deleted Content may be unrecoverable. Keep your own backups of originals.
8. Our rights to operate the Service
You grant us a limited licence to host, transmit, display, and process Content only as needed to run the Service for you (including delivery to guests you authorize, backups, security, and abuse prevention).
9. Indemnity
You will defend and indemnify Chilli and its operators against claims, damages, losses, and costs (including reasonable legal fees) arising from your Content, your galleries, your guests, your breach of these Terms, or your failure to comply with privacy/publicity laws.
10. Disclaimers and liability
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for lost photos, business interruption, or guest complaints about your Content.
Our total liability for all claims relating to the Service is limited to the greater of (a) fees you paid us for the Service in the 3 months before the claim, or (b) EUR 50. Some jurisdictions do not allow certain limits. In those cases, our liability is limited to the maximum allowed.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk, or for operational or legal reasons. After termination, Content may be deleted according to our retention practice.
12. Changes
We may update these Terms. The version date above will change. For material changes, we may ask you to accept again at signup or in-product. Continued use after notice may also mean acceptance where allowed by law.
13. Governing law
These Terms are governed by the laws of Romania. Courts in Romania have exclusive jurisdiction, except where mandatory consumer or other laws say otherwise.
